COMPANY NAME
Stonehenge Servers are part of Stonehenge Internet & Database Services Ltd which is also
available for hosting services at http://www.stonehengeinternet.co.uk. Stonehenge Internet &
Database Services Ltd hereafter called Stonehenge Internet reserves
the right to offer hosting space or services under the banner of
Stonehenge Servers. The terms herein are applicable for
services provided by either Stonehenge Internet
or Stonehenge Servers
whether the service provided is domain registration, hosting or
dedicated servers.
TERMS
OF SERVICE
By ordering virtual private server services from Stonehenge Internet, you (the Customer) agree to the terms and conditions set forth herein. Stonehenge Internet provides World Wide Web page hosting. Stonehenge Internet reserves the right to suspend or cancel a
customer's access to any or all services provided by Stonehenge Internet when Stonehenge Internet decides that the account has been inappropriately used or
otherwise. We may modify any of the terms and conditions contained here at
any time and in our sole discretion, by updating and posting at
this web page.
VIRTUAL SERVER SERVICE & USE
Stonehenge Internet agrees to provide the use of a Virtual Server to the Customer, for the exclusive use of the the Customer at the price and frequency of payment at order stage. Unless otherwise stated the Virtual Server is unmananaged and the Customer represents and warrants that the Customer has or has access to the knowledge and expertise necessary to configure, maintain, monitor, and secure the Virtual Server. Stonehenge Internet agrees to maintain the hardware on which the Virtual Server is located. With exception to the use or configuration of the SolusVM control panel, Stonehenge Internet does not provide telephone or e-mail support or any other technical assistance for the administration of the Virtual Server.
Stonehenge Internet reserves the right to refuse service and /or access to its servers to anyone.
Stonehenge Internet do not allow any of the following content to be stored on its servers:
Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation. This applies to material published in whole or part.
Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Stonehenge Internet.
Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
Stonehenge Internet reserves the right to disable a domain for abuse as detailed above. It may be possible to offer alternative hosting services on an alternative domain but in this event the original options have been lost and will have to be repurchased against the new hosting plan.

RESOURCE USAGE POLICY
(Webspace and Bandwidth)
Bandwidth overusage:
Overage charges on the Virtual servers can be avoided by upgrading the current plan before the resources are exceeded, if this is not the case then Stonehenge Internet will charge to your account the amount of 25p (£0.25) monthly per GB or part thereof used over the allocated bandwidth. Extra Disk Space is charged at the rate of 50p (£0.50) monthly per GB or part thereof.
PAYMENT POLICIES
All accounts are set up on
a prepay basis. Although Stonehenge Internet reserves the right to change prices of accounts or services at any
time all pricing is guaranteed for the period of prepayment.
Payment is due each anniversary year or month following the date
the account was established. Customers will automatically be
charged again at the end of their prepay period unless closure
notification has already been given.
Provision of the service is dependent on the receipt of all payments due to Stonehenge Internet. Regular payments are due on the anniversary date of the month for that month's service. The Virtual Service will be interrupted on those accounts that reach 3 days overdue through suspension or termination. Stonehenge Internet reserve the right to temporarily deny service or terminate this Agreement upon the failure of Customer to pay charges when due. Such termination or denial will not relieve the Customer of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees. Accounts not paid by due date are subject to a £10.00 late fee. The Customer accepts that providing on time payment to Stonehenge is their responsibility, and agree that Stonehenge Internet will not liable for any damages caused by interruption or termination of Service. In addition, Stonehenge Internet reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.
Vat invoices are downloadable from the Stonehenge clients area and hard copies are not posted.
Payment can be made currently in either UK sterling or US Dollars.
RENEWAL
OF VIRTUAL SERVER PLANS
Automatic renewal of virtual server plans will be undertaken and an
invoice sent 14 days before renewal, which may be payable by
cheque or credit/debit card. This is the case with both monthly or annual plans. This invoice is required to be
fully paid by 7 days before renewal date, otherwise the account
will be suspended.
Credit / Debit Cards:
Stonehenge Internet accepts Mastercard, Visa, Switch, Delta, Solo, JCB
and American Express.
Regular Payment Plans: (Monthly, or
Annual)
Payment
must be received at the latest within 7 days of the due date, otherwise
Stonehenge Internet will withdraw the services. The plan
may be cancelled at any time with 30 days notice and services will cease after one
month following the last payment on the due date, this does not
apply to Dedicated Server Plans (see below under Cancellation
and Refunds). Options to
hosting plans are paid annually and under no circumstances can
these be refunded.
Online or Cheque Payment:
This option is only
available to customers who pay annually for their Stonehenge Internet account. A credit / debit card number
will still be required if customers require the facility to
purchase domains and other services on-line. Stonehenge Internet cannot guarantee that a service will be
provided until after any received cheques or online transfers have been cleared.
CANCELLATION AND REFUNDS
Stonehenge Internet reserves the right to cancel the service at any time
in the event a customer contravenes Stonehenge Internet terms of service, a refund will not be issued in the event of a
cancellation. Stonehenge Internet will provide at
least 60 days notice to the customer in the event of the
services being permanently curtailed by the company. In this event
a pro-rata refund will be made to the customer for the remainder
of the membership period, if applicable.
Cancellation of a Virtual Server Plan taken through Stonehenge Internet or Stonehenge Servers, whether self managed or managed are subject to 30 days minimum notice. This is the case even if the plan has been taken on a monthly rate. Upgrading of existing Virtual Server plans are made free of charge.
If charges relating to Virtual servers, backup services or bandwidth/diskspace charges are outstanding for a period greater than 7 working days without prior agreement between the account holder and Stonehenge Internet, your service will be suspended.
INDEMNIFICATION
Customer agrees that it
shall defend, indemnify, save and hold Stonehenge Internet harmless from any and all demands, liabilities,
losses, costs and claims, including reasonable attorney's fees
asserted against Stonehenge Internet, its agents,
its customers, officers and employees, that may arise or result
from any service provided or performed or agreed to be performed
or any product sold by customer, its agents, employees or assigns.
Customer agrees to defend, indemnify and hold harmless Stonehenge Internet against liabilities arising out of; (1) any
injury to person or property caused by any products sold or
otherwise distributed in connection with Stonehenge Internet server; (2) any material supplied by customer
infringing or allegedly infringing on the proprietary rights of a
third party; (3) copyright infringement and (4) any defective
products sold to customer from Stonehenge Internet server.
HARDWARE & SOFTWARE CONFIGURATIONS
All Virtual Servers must use software configurations that conform with Stonehenge Internet requirements. Use of any particular software configuration may be declined at the sole discretion of Stonehenge Internet. Customers have no right or expectation to receive a hardware or software configuration on their Virtual Server that is more capable than that which was initially ordered from Stonehenge Internet, nor can a Customer expect to receive support from Stonehenge Internet with respect to the correction of errors caused by mistakes, faulty settings, and installation errors caused by the Customer.
BACKUP SERVICE
Stonehenge Internet always recommends purchasing backup space with Virtual Servers. Stonehenge Internet operates a daily rotating backup service for those Virtual Servers that have subscribed and where payment is not outstanding. Restores are actioned by email by raising a ticket in the Stonehenge Internet Clients area.
VAT
All prices stated are applicable to VAT at the current rate
unless otherwise stated. For orders made from the UK or European
Union, then VAT is applicable, otherwise orders will be VAT free
and the exempt button must be applied on the product payment
page.
